Re: resignation

An employee who resigns from a job terminates his contract of employment and therefore has obligations imposed on him by the Labour Act 2003, (Act 651).

Section 17 imposes a duty on either party to give notice to the other party depending on the nature of the contract of employment.

a) in case of a contract of three years or more, one month notice or one month pay in lieu of notice.

b) in the case of contract less than three years, two weeks notice or two weeks pay in lieu of notice.

If it is an employment contract determinable at will by either party, it may be terminated at the close of any day without notice. Thus if the employment contract is of this nature the employee need not give notice. In the circumstances that a notice is required it must be in writing and the day on which the notice is given is included in the period of notice.
