Legal Question in Business Law in Guam

monopolies/anticompetitive business practices

is there any violation of federal antitrust laws when two brothers establish a business independently.

Brother 1, sets up printing business

Brother 2 sets up the largest (currently 2 suppliers on island - the other supplier only has limited supply of paper)printing supplier on island. Supplies are purchased through Unisource in California.

Brother 1 (printing business) is able to manipulate prices because of what I assume favorable prices given to him by brother 2.

Re: monopolies/anticompetitive business practices

Assuming United States federal law applies where you are [you don't say], the general rule is that a conspiracy in restraint of trade, the effect of which is to disrupte normal commerce or cause an artifical price increase beyond that generated by the ordinary operation of the marketplace, will run afoul of stautory prohibitions against price fixing. A monopoly in and of itself is not necessarily illegal; it becomes so only if it results from and in one of the situations stated above.
