Legal Question in Credit and Debt Law in Guam

Collecting on past due debts

I work in a dental clinic based in Guam. I'm not sure of our statue of limitations when it comes to collections. My question is: if a balance was for services done in 1999 but last statements were sent out in 2006 with no record of a returned mail, can I still send this account to a collection agency or is it considered a dead debt?

Re: Collecting on past due debts

The statute of limitations on a debt evidenced by a contract in writing is four years from the date of the service or the last payment by the debtor, which ever is later. For a contract not in writing, the statute of limitations is two years. If you have not received a payment from the patient in the last four years, the bill is not collectable. Of course the patient may not know that so there is nothing stopping you from sending the bill to a collection agency.
