Legal Question in Criminal Law in Guam

Child Abuse

What Law protects ''professionals'' who were arrested out of the school area for child abuse yet are not transferred by the Director of Education away from the children and continues to be allowed to stay in the same school in the presence of children? This is happening in our Guam school system

Re: Child Abuse

Child abusers are not protected by any laws other than those applicable to all criminal defendants.

The decision of the school superintendent about whether or not to continue the employment of a convicted child abuser will probably turn upon whether or not that person has abused a child within the school system. Abuse outside the system will not necessarily result in termination, particularly if there has been no criminal conviction.

If there is a potential danger to children within the school system from this person and someone is failing to act because of family ties or some other reason, the matter should be brought to the attention of the school board.

Good luck. Hafa Adai
