How soon can I divorce him?

I got married in Guam last year. I now live in California and would like to divorce my husband. How soon can I divorce him?

You can file for divorce in California once either yourself or your spouse is a resident for 6 months. Also, either yourself or your spouse must be a resident of the county that you are filing in for at least 3 months. You can also immediately file for a legal separation if you do not yet meet the residency requirement.

You must be a resident of California for at least 6 months before filing divorce. If you haven't been here that long, you'll still want to consult a family law attorney to plan ahead and be ready for filing, plus know your rights and what to expect.

You need to be a resident of California for 6 months and a resident of the County you intend to file in for 3 months.
