Legal Question in Family Law in Guam
Off-Island Divorce
I'm german my husband retired us military, currently working for the army in South Korea. He wants us to file for an uncontested divorce in Guam whereby he expects me to waive any claims on our property, alimony and child support. He thinks that everything belongs solely to him and that I have no right to get any of it. If I would agree to it can I appeal this decision later? I am under a lot of pressure by him, because he threatend to take our children and leave if I don't agree to it. Also, is it fact that we would have to being married for 10 years to do this kind of a divorce?

Re: Off-Island Divorce
Do NOT Agree to give up all of your assets, your possible interest in his retirement, child custody or child support. If you do, you can not later appeal. You might be able to get child support at a later time, but you will have to show a change in circumstances. You may not qualify for a share in his retirement, it depends on how long you have been married. In general, don't give up your rights and hope you can undo the damage later.
