What are the legal requirements to form an LLC? Can a foreigner be a partner in an LLC?

The filing requirements for an LLC are not complicated -- it varies by state, but the certificate of organization contains simple elements like name, address, etc., and the forms are often available for internet download. However, an LLC also should have an Operating Agreement between its members, and this should not be done without the assistance of a lawyer.
Non-US persons can be members of LLCs. They should consult qualified tax advisors before doing so.
