Legal Question in Business Law in Hawaii

Time Share Contract

My elderly parents entered into a time-share contract about 20 years ago that was supposed to be a single-payment with no maintenance fee. Subsequently, the co. president embezzled money and the new management gave the members the right to break the contract or agree to a new one. In the new one it stated tha the board "could" if it was found necessary, impose a maintenance fee. That maintenance fee for one week is now $396.00, having increased every year. They have also imposed new fees on upgrades and certain time periods, which used to be free. My parents can no longer use it due to age and I have already taken one week. Is there any way to relinquish this "right to use" in the time-share without putting a bad mark on their credit record?

Re: Time Share Contract

You gave some information, but not enough legal information to give you a reliable answer. I specialize in business and contract law so I deal with disolving contracts all the time. Your parents may be able to get out of the time share since the terms of the contract have changed drastically since they entered into the original contract. I would need to see a copy of both the contracts and speak with you regarding the sequence of events in order to give you a clear picture of what your parents' rights are in this situation. I can be reached at 888-563-8529. The call and the consultation are free. I look forward to speaking with you.
