Is there a legal document I can get to have my fiance's brother sign stating that he will pay us back money plus interest if we paid off his mortgage loan. My fiance's mom had let my fiance's brother use the house to take out a mortgage amount left is about $50,000. My fiance's mother is giving the house to my us and we are refinancing the mortgage paying off existing mortgage which my fiance's brother is paying on now. Reason for refinancing we are renovating the house. I would like to have a legal form to have my fiance's brother to sign stating he will pay me back plus interest.

You would want a mortgage and promissory note for adequate protection. It would be fair for your brother to cover the cost of preparation of these important legal documents.
