Legal Question in Criminal Law in Hawaii

criminal theft case

I have been sup. to testify against a former employee that stole and forged. This happened while I was often not present as I was undergoing cancer treatments and my mother was dying. I asked the prosecuting attorney if I could give a sworn deposition and he said no. He said that if I do not testify, I can be held in contempt of court and punished. This is too stressfull to me and my employer states they suport my decision not to testify. What can I do? This is a state of Hawaii felony case

You are obliged to honor the subpoena and appear at the noted palce and time. You should carefully review any prior written or statements you have made before you testify. If you do not know the answer to certain questions, possibly because you were not present or aware of something, you should state clearly that you don't know.
