Legal Question in Criminal Law in Hawaii

Cutting off a finger a crime?

I've never heard of a law pertaining to

this. Is it categorized as mutilation?

What law code/text should I review on

this.

Re: Cutting off a finger a crime?

The criminal statutes pertaining to cutting off a finger (presumably somebody else's) is Malicious Wounding if it was intentional 18.2-51. This statute classifies it as a Class 3 felony (5-20 yrs) or if it was not malicious then it would be unlawful wounding a Class 6 felony (1-5 yrs), if there is permanent disability it's aggrevated malicious wounding 18.2-51.2 which is a class 2 felony (20-life).

If it was unintentional and nonmalicious it could be classified in the misdemenor assault context. It all depends on the facts.

Good luck.
