Father Tricked, now not allowed to see daughter
My husband was divorced in '01 and was tricked into signing over full custody of his daughter to his ex. He was misguided, could not afford an attorney and she and his mother said he would have normal custody rights and the strictly regulated visitation in the papers were only temporary. They said it would later be changed as she got older. This was untrue, they have refused him talking to her over time, not even the strict visitation is adhered to, and it has been a year since he has seen her. He called his ex the other night and she hung up the phone as he was leaving a message. He is always faced with fiery confrontation any time he calls her and she returns his calls. She has tried to make him look bad by any scratch on her linked to him or step-kids, it's rediculous. He wants to give up which is what she wants. I want him to fight for her, but what can he do? His mother who has turned against him because he no longer wanted to be married to his ex, is now vowing to make sure nothing goes in his favor in court with every dime they have.He is heartbroken and needs to see her but lacks the thousands of dollars for possible failure in court. Is there any way he could modify the final judgement and get joint custody?
