Change of status denied, now what happens
My wife entered the country 14
months on a K-1 visa. We married
and had a child. WE applied for
change of status. At the interview it
was determined that income for
affidavit of support was insufficient. I
was given 84 days to show sufficient
income or get joint sponsor. What is
her status if I cannot do this? What
about the baby? She was born in the
US. I do not want her to leave the
country. My wife is unhappy here
and wants to return to her country,
but does not want to leave the baby.
What are my rights? The marriage is
bust. I am prepared to take are of
the baby myself.

You may show sufficient income through a joint-sponsor as well who does make enough to satisfy the affidavit of support requirement.
