Legal Question in Immigration Law in Hawaii

Hello,

I am running a very low budget visiting artist series. I plan to invite an artist from Spain to participate in an artists residency. I will provide room and board, while he will pay for his airfare. He is planning on filing for a tourist visa since he is a new artist. Do you reccomend that I file for an i-134 even though my income is very low? I make around 24,000 yearly.

His source of income is a family business, and he has considerable ties at home, car, lives in parents second home etc...and is able to show these documents. Is it more appropriate for him to show self support instead?

Thank you,

Aerin Turnquist

Dear Aerin:

First of all, it would have to be clear that a B2 was permitted for this type of activity. Next, when one comes on a B2, generally an I-134 is not required and the person coming must show themselves they have sufficient funds not to have to work.
