Legal Question in Employment Law in Hawaii
Personnel File
Is an employer allowed to place in your permanent personnel file a note alleging that he thinks you may have padded your time sheet. He has no proof or basis for the allegation and all the time can be accounted for (including statements from inspectors and sub-contractors); however, he insists on putting this comment in the employee's personnel file.

Re: Personnel File
Your employer has defamed you by libel. Libel is defined as defamation in writing. Defamation is any published statement that causes injury to one's name, reputation, or character. Tell your employer to remove this information immediately from your personnel file. If you have any further questions, please contact me at [email protected]. T.J. Lane
