Who can act as landlord in renting property?

My husband, myself and sister own

property together which has two

homes on it. We live in one and the

other is rented to a tenant by my

sister without our permission. Are we

liable for suits brought by tenants or

responsible for tenants actions that

affect property?

You are one of the landlords. You are liable for injuries to tenants and possibly their guests. You are entitled to part of the rental income unless it is a trade for use of your house. It is important that you have a co-tenancy agreement drafted indemnifying you and your wife from liability and defining the rent share agreement.
