Legal Question in Landlord & Tenant Law in Hawaii
If the landlord (payor) writes on the back of a check "Accepted as full and final refund of deposit", and then I (tenant) endorse the check to deposit it, am I truly giving up all my legal rights in regards to the security deposit held by the landlord for his residential rental property?

No. The only way the landlord can keep a portion or all of the deposit is to let you know what the money is being withheld for and how much. Scribbling accord and satisfaction or a waiver statement on a check where it is difficult to find is not going to hold up in District Court. Aloha, Jon A. Zahaby, Esq.
