if a tenant refuses to sign a rental agreement and or avoids talking with the landlord what can we do legally under the law?

The rental agreement would probably be determined to have converted to a verbal month to month rental. If the tenant does not pay rent they can be evicted quickly. If they are paying rent then 45 days notice must be provided and they can be evicted thereafter.
