Changing contingency law firm?

Can I change to a different law firm on a contingency case? They have filed suit to protect statute but not served it. They are out of pocket for one expert. But I disagree with the way they are handling my case and would like to find another lawyer. Am I legally able to switch? Will another lawyer be reluctant to take my (very serious injury) case, because they don't want to step on the toes of the first lawyer?

You are always able to change lawyers, however read your current lawyer's fee agreement carefully to check the terms that apply upon release. Generally, your former lawyer can have a "lien" against any recovery for the actual time spent on the case, but will not receive a 1/3 fee of the recovery. Many times the lawyer will not seek any fee but rather will just seek reimbursement of his/her out of pocket expenses incurred. Lawyers will look at the merits of your case and determine the difficulty of recovery.

You can change attorneys - but it is often difficult. Many cases where a client wishes to change attorneys, the case is a difficult one and they were lucky to get an attorney at all. One situation where it can work out to the best for all concerned is the situation of an overworked attorney who is simply not getting to a client's affairs.
