Legal Question in Personal Injury in Hawaii

I was hit by a truck while riding my bike. Medical bills about $15K. Is there a general rule on how much I am compensated for pain and suffering? They offered $17K. I have permanent bump on my shoulder where my collar bone was broken and stiffness/slight pain after almost a year. Prior to accident, I rode my bike outdoors about 40 miles a week. Since accident, I no longer ride outdoors.

The short answer to your question is "No, there is no general rule." The value of a case depends on all the facts and circumstances of that case. One important consideration is how well the evidence which will be crucial to the jury is developed and submitted to the insurance company (so they know exactly what admissible evidence they will face at trial).

Thirty years of being in the business and I can assure you that no insurer is going to offer you anything close to full value on your case when you are unrepresented. Why should they? Their profits are increased by every claim on which they underpay. The average lay person who has not worked in the business for decades is really are unfamiliar with the proof which is needed to obtain full value on a PI case. An unrepresented claimant is like a gunslinger who brings a water pistol to the O.K. Corral. Cute, but noone else is going to put blanks in their gun in response. Insurers have training sessions for their adjusters to teach them what not to say and how to appease claimants in order to keep them from getting lawyers.
