Legal Question in Personal Injury in Hawaii

property damage liability

water from a broken water heater in our townhouse unit (which we own) leaked into the adjacent unit, warping their laminate flooring. Assuming we are responsible for repairs, what rights do we have--that is how can we know the other owners won't choose the most expensive flooring and contractor and leave us the bill?

Re: property damage liability

Your neighbors are only entitled to be put back into the same position they were in before the incident occurred. They would have to pay for the difference between the value to replace or fix comparable flooring to what they lost and any upgraded flooring.
