collecting tenant damages
I have presented a tenant who trashed my condo during a 5 month rental time period with a bill for repairs.
He is disputing some of the charges and wants the management company I hired to do the repairs to produce receipts. He is also claiming that he does not have the funds to pay the damages, which far exceed his security deposit,which I have kept.
What is the management company required to produce in the way of receipts and what am I therefore required to produce. How can I most quickly bind his pay, etc., to pay off the cost of the repairs?
I have photographed much of the damage.
He also claims that he informed me about a broken dishwasher that he says never worked. I only recall that he told me about it when he gave notice.
He was repeatedly late with rent and bounced one rent check and didn't pay the rent until the 21st of the month. I also had repeated complaints from the resident manager about noise and unsupervised children.
I have a lease which he signed that indicated all appliances were in working order when he took possession, etc. and the condition of the condo overall.
I am prepared to sue for the damages and want to do so as quickly as possible.

Yes you can sue for damages and you will need evidence (receipts) of your payment for the tenant damages. You will be able to garnish his assets once you get a judgment for the damages. Let me know if you want to proceed right away with an attorney. Jon A. Zahaby 808-526-0892
