Legal Question in Real Estate Law in Hawaii

Anyway to Sell Property?

We want to sell our property which was given to us by our parents. There are 6 of us (children) and each child holds an undivided 1/6 interest in the property. All of us want to sell except for one who says that they'll ''never'' sell. We understand we can take them to court and force them to sell, but I hear that it's expensive and I also don't want to sue my own family. Buying the sibling out isn't an option as they are living on the property that was given to us and want to stay there. Is there any other way for us to sell without the one person's consent?

Re: Anyway to Sell Property?

A Partition Action is the only way to sell. The property would be subject to public auction. The Partition would cost around $10,000.00 in legal fees + costs because the unwilling family member really has no defense. Aloha, Jon A. Zahaby
