Legal Question in Real Estate Law in Hawaii
tenants repair resposability
our air condition drain line feeds into a exsisting plumbing line in are shopping center the plumbing line is not part of our space the plumbing line was found by our air conditioning company its the onlydrain we found we spent 5000.00 on the unit, managment knew we were installing it. it cannot be moved now. the problem is the plumbing line is leaking from somewhere along this pipe that is in the intreior of the shopping center walls, but not our space. we have been told that the pipe is leaking into another tenants space in the shopping center and the are putting the blaim for damages on us. the thing thats hard for us to understand is the air conditioner has been up and running for about 4 months without anybody saying anything to us. we would like to know who's responsibile for the fixing of the plumbing. our lease states 2 things and i quote exactly how it is written;
under:
maintenance expenses: '',plumbing repairs,''
we pay approx $400.00 a month for this expense which includes many other things
repair and maintenance:''tenant shall be responsible for all interior repair and maintenace including plumbing and electrical fixtures, air conditioning, etc.''
please help

Re: tenants repair resposability
From the information I have so far - I would say you need 2 things: (1) your own plumber expert to determine the root of the problem and; (2) An attorney to review your entire lease agreement.
