Legal Question in Wills and Trusts in Hawaii

revocable trust

My father changed his trust two months before he had a major sroke. Prior to this he was debilitated by small strokes (*falling down)which left him unable to speak.

Is this a case that the courts would hear and invalidate the last trust change?

Re: revocable trust

It is possible, depending on the facts. Trusts may be invalidated if the court finds that the Settlor was incapacitated when they signed the trust.
