Compromise & Release Settlements

Is there a formula used when determining the amount of

the settlement or is it done by a percentage? Also what information is considered when determining the settlement ie; lost income,future medical expenses, quality of life issues etc. And if it's a Longshore Harbor Workers Compensation Act case, does it make a difference on how the case is settled? Thank you for the assistance.

I can't advise you about settlement in a longshoreman's case. However, in a state worker's compensation case, the total settlement (permanent disability) amount you receive is based on your permanent impairant expressed by a percentage (usually done by a rating) plus subjective complaints which are expressed by a percentage.
