Legal Question in Construction Law in Idaho

contractor wont let us on our property during business hours

Our builder told us(after he started the project) that his insurance doesnt allow us to be out there during business hours. A couple weeks ago we went out to snap lines on the main floor and he said it was ok to come out during my husbands lunch hour. A few days later he told us to not come out and do that during business hours anymore. He snapped lines on the top floor, we went out 3 days to see them, he snapped them wrong, I called him, he said he would resnap and for me to come out after 430. Finally we met him at 7 am (he was late) and he said he didnt snap them because we werent there to see them snapped. I told him he has asked me to come out for 3 days AFTER he gets off work and now he tells me he wanted us there during work. I think he is mentally ill or a pathological liar. He is now charging me a change order for the lines he wouldnt snap correctly. Do I have to pay? Can I demand him to do change orders BEFORE the change or I am not paying for them. He has refused to to that. Can I get rid of him? I do not have an out clause in my contract.

Dear Inquirer: 'Sounds like you have a serious problem with an erratic, uncooperative contractor, warrantiong immediate discharge.

I am not admitted to practice law in your state, but I'd consider it.

First, what does your contract provide as to termination of your contractor? Discharge for cause may be worth considering. Because your problem appears more complex than what we can discuss here, I'd suggest you contact and retain an experienced construction attorney ASAP, to protect your rights and interests!

Construction contracts consist of time, emotion and money... you should not risk any of these valuable assets with the wqrong contractor.

Good luck.

Sincerely,

J. Norman Stark, Cleveland, Ohio.
