Legal Question in Consumer Law in Idaho
Buyers rights on used cars
I test drove a car yesterday, tonight I went to purchase it. I got 20 miles from the sellers home and the engine blew. I called the seller and told him what had happened and also told him that I wanted my money back. He argued with me and basicly told me no! I told him I would then see him in court. I had to call a towing company to pick the car up and deliever it to my husbands business. The seller had told me that the engine was rebuilt three weeks ago and he had a written warranty for it. I want to know if I have any rights as a buyer of a used vehicle. It will be worth it to me to take him to court if I do have rights as a consumer. Please let me know as soon as possible and thank you for taking the time to review my question.

Re: Buyers rights on used cars
Not under the car statutes since there is no express written warranty there can be no lemon law application. However, if the salesman lied to you then you can sue the dealership under the Id Consumer Protection Act for their wilful misrepresentation and contact the Id Attorney General-Consumer protection division and they will take your case for free if enough people have filed complaints against the same dealer.
I give a free 1/2 hour consultation in my office if you call me at 208-345-3817 and make an appointment. You should definitely hire an attorney to represent you in this type of case. If you don't feel comfortable with me then I will suggest another to handle your case.
