Legal Question in Credit and Debt Law in Idaho
Collection of Debt
I sold a car to an individual-they set up the payment schedule-$125.00 2xmonth-as of 4/4 they will be 5 payments behind. I am listed on the title as lien holder and have the title-what are my rights and how should I go about collecting payment or the car?

Re: Collection of Debt
Your rights would depend on what you spelled out in the promissory note and retail sales contract that should have been signed at the time of sale. If you did them right, you can do the steps indicated in those documents (which should include repossession and/or suit). If you didn't do proper documents to protect yourself, you may be limited to suing. We would need to see the paperwork to fully answer you.
