non-payment for installation of water system
We did a job installing complete pump system $9500.00. Owners kept telling us they were getting a draw on there loan and sending us a check. This never happened. We put a contractors lein on the property on 3/28/07 and found out the owners closed there loan on 3/06/07. We spoke to this customer about payment. He wants to make payments to us I told him I could work with him on the labor but I needed to be paid for the materials listed on the bill to pay my creditors. That was 2 weeks ago. What should we do to collect our money? Our business is very small, just myself and my husband and our son just started working for us. I guess just get a lawyer and go to court. I would hate to drive these people to bankruptcy and get nothing.....This is a brand new home. I called them and left a message that we could take a credit card but they never called me back.

You will likely need to foreclose contractor's lien, but first you should have an attorney issue a Demand Letter to them setting out consequences if payment is not made immediately.
