Juvenile consentual sex

I have a nephew whose parents are divorced. His father and step-father are foster parents for the state of Idaho. They took in two girls for a week and during the course of that week my nephews visitation had started. My nephew is 15 and the girls involved are either 12 or 13. According to my nephew his step mom went to Washington and his dad went to work. While they were alone he had intercourse with one of the girls. His step mom is now not allowing him to visit his dad saying that she will have him charged with rape. Is this possible? or does the responsibility fall on the foster parents? Also they are claiming that they had recorded the incident on video, is it against the law for them to keep this info in the first place?
