Legal Question in Family Law in Idaho

Cancel a divorce

I live in Bannock County, in Idaho. Can I cancel my divorce petition? I feel I am not being represented well and suspect that my husband has interfered with the justice system by paying off my lawyer and the custody evaluator. I want to cancel the divorce, move to another city in Idaho, establish myself with another lawyer that is a friend of mine, and get on with my life. We are in a big custudy battle and I would assume dropping the divorce (I filed it) and he can carry the burden of filing all over again. Can I do this?

Re: Cancel a divorce

If you filed it you can dismiss it with a simple motion to dismiss the case. It's possible tho not very likely that the case has gone too far. For instance you might not be able to dismiss without consequences if your husband has filed a counterclaim against you requesting divorce as well. then you might lose by default judgment. You need to have an attorney review your case to make the best decision on dismissing it.
