Name change specifics

I recently married for the first time, I have children from a previos relationship and was wondering about the specifics to getting my childrens last names changed. They have my maiden name as of now, the father is not around. Does my new spouse have to adopt in order to carry his last name? Please let me know. Thanks

You can file a simple motion for change of name under Idaho Code sections 7-801 and 802 to file a petition and you also must publish as well according to the terms of the statute. I give a free half hour consultation in my office if you call 208-345-3817
