Legal Question in Family Law in Idaho

How child support is figured?

My husband was married and had 2 kids. his wife cheated on him, they divorced. she lives in montana & has custody. he pays 300/mo childsupport to them.

gets mixed up with this girl in idaho. she gets pregnant. do a dna, it's his. my question: i found the paperwork they used to determine how much childsupport he would have to pay for this ONE child in idaho. they used her income, what she COULD be making. they used his income. BUT they did not deduct the 300/mo for his other childsupport obligation. so he pays an addition $300 for this ONE child in idaho. Aren't they suppose to use the other obligation to take off his income? just how does idaho determine the amount. my ex pays my 175 a month, which i think is fair. 300 for one child seems quite a bit! (she has another one from another guy..lives on childsupport and her current live in). Thanks

Re: How child support is figured?

All children sired by your husband must be taken into consideration in determining his child support amount. I can only guess that he didn't have an attorney at the time the ch supp was determined and he didn't tell the court about his additional child. I give a half hour free consultation in my office.
