Legal Question in Family Law in Idaho

Child Support not paid.

Have a judgment for child support, approx. $12,500. Child is now 9 months away from finishing high school, and also turns 18 in 7 months, wants to live with other parent now.

Will I have to pay support to other parent, even tho' I'm owed over $12K?

Re: Child Support not paid.

Generally, you can get an order setting off your hypathetical payments to him on a monthly basis. However, if the child is 18, or 19 and still in high school, you would have to pay child support. Otherwise you wouldn't. However, I'd go get a garnishment against him and start to collect on the judgment he owes to you.
