Legal Question in Family Law in Idaho
faslely accused
My daughter didn't get her way at home and went to school and told them I beat her. She was put in foster care. I went to the first court hearing, instead of being in front of a judge, I was told I was guilty by the 7 people representing her from all the children's org. I have to sign this contract or they will charge me and put me in jail. She is 16 and spoiled rotten. What can I do?

Re: faslely accused
You have two choices: 1. tell them that you will not sign anything and hire an attorney to fight these charges in court, or 2. Sign the documents which usually include a statement that you have committed the acts alleged by the kid, and you have effectively admitted you are guilty should criminal charges be filed against you later.
You might be able to get them to put in the paperwork that you don't admit any wrongdoing but you are willing to go thru parenting classes and family counseling to get your kid back.
I lied: there are three options: 3. Keep your mouth shut, don't sign anything, and let them keep the kid.
I strongly advise you not to sign anything without having a criminal attorney review the same to make sure you are not admitting to a crime, DO NOT DISCUSS the facts with anyone except your attorney as he/she is the only one that can't be forced to testify against you, and DO hire an attorney as soon as possible.
I give a free half hour consultation in my office. Call me at 208-345-3817 for an appointment if you'd like a free evaluation of your case. If you don't like me or don't feel comfortable with me I will find you another attorney that does this kind of case.
