What are a Father's rights to custody of minor children?

My brother in law is seeking a divorce and his wife assumes that she will have full custody of thier children and the right to withhold children from him. He would like to seek custody and needs to know where to start. The children are currently in the mother's care because he is in the hospitol (released today)after a house fire. Please help! Where do we start?

Start by retaining a family law attorney in your area. When dealing with divorce which involves children, I do not suggest going at it alone. In florida, issues dealing with children deal with the best interests of the children. In florida, if someone states that there should not be any contact with the other parent, then the parent making that request must show that the other parent is abusive and other issues that would harm the children. Usually if there are these allegations there is supervised visitation.
