file foe abandonment and child support

i would like to file abandonment on absent father and take all parental rights away from father and make him pay child support

Filing for abandonment is usually a condition precedent to terminating

his parental rights. If this happens, he is no longer the father and

no longer required to pay child support. If you pursue termination on this

ground, the abandonment must have consisted of one year of no contact with the

child and no payment of child support to prove a prima facie case.

You can file a motion to have his visitation rights taken away or restricted in

some way. This option does not terminate his obligation to pay child support.

Therefore, if you want to continue receiving child support, you certainly don't want

to terminate his parental rights, just file a motion for restricted or no visitation

and for contempt of court for failing to pay child support. If the court finds him in

contempt, the court can put him in jail, take away his driver's license, etc.
