Missing Child

My sons wife moved out of the home taking all thier money and thier 3 year old daughter. We are afraid she may be planing to leave the state with his daughter. We currently know where she is but she refuses to allow us to see the child and will not even return our calls. Is there some papers we can file and serve her with restraining her from leaving the state with the child? If so can we file them ourselves or do we need the assitance of an attorney. We haven't much money.

You need to file a petition under the grandparent rights

statute, Idaho Code section 32-719, which grants grandparents

visitation rights to their grandchildren. You must show that

it is in the best interests of the children for the court to

grant such rights to you.

If you want to have any chance to get visitation rights

I strongly suggest you get an attorney.

In your petition you can ask the court to issue a restraining

order restraining your daughter in law from removing the

children from the jurisdiction of the court.
