Legal Question in Family Law in Idaho

Parental Power of Attorney

My husband is over seas in the Military, he has two sons from his first marriage. He has joint, but physical custody of the younest son. The younest son age 14 lived with us until his dad left to go over seas. The child does not want to live with his mother. Both his mother and older brother are on probation and in alot of hot water. He wants to move back home. His father has given me Parental Power of Attorney for the child, but his mother still wont let him move back home. I am trying to get more info on cases like this. Is ther anything out there? Please if you can help me.

Thank you,

Re: Parental Power of Attorney

there is no such thing. Powers of attorney only apply to property. YOu will have to file for guardianship of the child and get a court order for guardianship. I give a half hour free consultation in my office if you need more information at 208-345-3817
