Legal Question in Family Law in Idaho

Parent/High School Student's Rights

I have had full custody of my son for the past seven years. He is now 17 years old and ran away from our home in Texas. He is now in Idaho with his biological mother and wants to remain there. He is enrolled in high school in Idaho. Under the custody agreement, I have the right to decide/know about my son's education. I was turned down by the high school when I asked for information about my son's grades/classes. Although they have a copy of the custody agreement, the high school states that my son has requested that they do not give any info to me and they are granting him his privacy. Can this be done? What are my rights as a parent with full custody?

Re: Parent/High School Student's Rights

If you have a valid custody order then you should be able have full access to his records regardles of your son's desires. As a minor your son's permission or denial of release is of no consequence. Note, that changes the day he reaches 18.

Your problem is enforcing the order. Without more information its impossible to advise you much further. The best course would be to contact a Texas attorney. A letter from an attorney may bring the school to rethink their position. It is also most likely that Texas courts still have jurisdiction and could issue an order to compell release of the records which under Federal law would be enforceable in Idaho.
