Reimbursement of Medical/Day Care Expenses
My duaghter's father is continuously late paying day care and reimbursing medical expenses. How do I go about getting reimbursed if he refuses to pay? He has been putting me off for three weeks on the latest medical bill, and is pretty far behind on day care. Also, I have been very flexible with his visitation, allowing one additional visit per week than the divorce decree states. Now that my daughter is in kindergarten, this additional day is causing a disruption in her routine. She has ''home fun'' that she has to do and he does not help her with it, so we have to do it when she comes home and should be in bed. I brought this up to him and he said that if I take away that date he will take me back to court and since I am married, he can count both mine and my husbands income. Is this true? Also, if he works ''under the table'' how does that work in calculating child support?

1. Quit giving him more than set forth in the decree. After awhile he'll be able to ask the court for a change in the schedule because you have been allowing it for a substantial amount of time.
2. your new husbands income IS NOT used to determine the amount of ch supp your ex pays.
3. Tell him if he does not pay the daycare, etc. that you will file a motion to have him held in contempt of court and will ask for sanctions against him which could include jail, fine, all your costs and attorney's fees to get this done.
