Legal Question in Family Law in Idaho
shared transportation
my divorce was in Idaho. My kids live with my ex there.I live in seattle. I have been picking up the kids ever since the divorce everyother weekend. this is getting to be expensive and hard on my vehicle and me. I am wondering if it would be possible to take her to court and have the transportation split or will it be of no use.I dont know if Idaho law stick up for my ex or not.She is not at this time willing to do it on her own.My divorce papers say that I am responsable for the transport but do you think it would be worth the court.I am not in a good financial standing to go to court of it wouldnt help. thank you..

Re: shared transportation
If the divorce was in Idaho then I advise the following. If the divorce was elsewhere, I can't help you because I am only licensed in Idaho.
1. to change the custody order you must prove 2 things be a preponderance of the evidence (i.e. by the greater weight of the evidence) Num 1) that a substantial and material change in your or her circumstances has occurred and NUM2 that it is in the best interests of the child to do so. But, this would hinge on your income and her income. If she now has income enabling her to pay these costs and she didn't have this income at the time of the divorce, this would constitute a material change in circumstances and you might be able to go to court and prove your position.
