How gets the house in a separation? Does he have to pay alamony? If one of us have already left the house but would like to return would that be ok to do?

I am assuming that you haven't agreed to the separation according to the separation statute of ID and that no court orders of any kind have been entered. My answers are based upon the foregoing assumptions. If the assumptions are incorrect, please disregard my advice. 1. you or he can move back into the residence at any time. 2. if both parties agree that he can return then he can. 3. If both parties don't agree, he probably can also return because he wouldn't be violating a court order.
