Termination of Parental Rights

My husband and I would like to adopt our nephew that has lived with us sense he was 6 months old (now 11)and who we have guardianship. Do the biological parents have to sign in front of a judge giving up parental rights? His biological mother lives in Missouri. Is there a form that I can send to her for permission. She is in agreement about the adoption.

you must terminate both the mother's and father's parental rights before an adoption can occur. Yes, they need to sign a consent to terminate parental rights for rights to be terminatedf. You must use a propert form to do this then file it with the court.

you can generally file both the termination and adoption cases together.

Note: they must sign away their rights before a notary public and generally use the acknowledgment for of notary public
