Legal Question in Insurance Law in Idaho

Son bit by neighbors dog.

On 10-16-01 our son was bit by the neighbors dog. He was bit on the nose (it took a chunk off the end of his nose) and one of the dog's teeth can with in a 1/4'' from my sons eye. The neighbors homeowners insurance paid all the medical bills. That is all we have received from them. Our doctor indicated in his notes that my son would probabley need plastic surgery when he got older. The insurance office is now pressing us to close out this case. Our son is my only 5 and we want to wait for a couple more years before we did have plastic surgery. The insurance company is not willing to wait. They have never offered us any settlement amount for pain and suffering that our son endured or anything. The total amount they have had to pay out is $450.00 for medical bills. Legally what can we ask them for?

Re: Son bit by neighbors dog.

typically, an insurance company wants to settle a case against its insured for mere pennies on the dollar based on the true value of your case or claim. often times they "hurry" the settlement process before you have a chance to contact an attorney so that they hopefully get you to settle your case before an attorney can assess the true value of your case. it sounds like this is exactly what HOA insurance company is trying to do to you and your son based on the facts you have given me so far. i STRONGLY recommend that you speak with an attorney ASAP, BEFORE you sign anything given to you by the insurance company, in order to further evaluate your case and what it is worth. if you would like further assistance in dealing with this insurance company and getting the highest maximum settlement/award possible, feel free to contact my office today and it would be a pleasure to help you fight for you and your son's rights against this insurance company. I You need to contact an attorney..and try to negotiate the amount. Your case has very good potential. I am in Los Angles and can handle the negotiation but in event of a litigation in the future...I will need to associate with an attorney in Idhao.
