We want to hire a mechanic. Unbeknownst to us, he has epilepsy and could have a seizure at any time (while under an engine or while standing over a running piece of equipment). What is our legal right as an employer to his health information? He says he can do the job, and he can, until he has a seizure. Then who is at fault? Were can we find documentation for this in our state or federal laws. If we hire him, and we later suspect this is the case, do we have any rights? What if he develops this condition a year after he is hired?
