Legal Question in Employment Law in Idaho

Need help with a job contract that I accepted

In April of 2006, I accepted a position with the company I am currently working for. The job offer contained a very nice re-location package and I ended up signing the job offer. One of the stipulations in the job offer was if I quit or am fired for misconduct within 24 months, I have to repay all moving expenses including taxes.

This could be as much as $50,000

My problem. My company just suffered huge losses last quarter and are outsourcing just about everything. I would say that in the next 2 months, I will be fired.

The day they announced the company restructure, I started applying for jobs expecting I was going to get cut in the first round. I didnt get cut and now have a great job offer. Its for less money but with a great company.

I want to get out now, If I wait, a vast majority of the currently available jobs will be taken by the people who get out now. Our boss has stated no position is safe so I have little hope of not being cut.

Right now our personal budget is so tight, there is no way we could afford the loan to cover the repayment. I dont want to move and we are completely upside down on our house anyway

Any suggestions on what I can do?

Rock vs. Hard place? I would like to get more info before a final opinion, but you should know that "misconduct" is not the same as missing your numbers.call or email
