Legal Question in Landlord & Tenant Law in Idaho
how do i get in my new home
I closed on a home the 12th and took ownership on the 14th. The old owner said it would be vacant the 15th. When I went there the renters were still there and said they didn't get an eviction notice until a couple of days ago. The old owner was paid up in rent until Dec.1st. Meanwhile I have to pay for the time I can't live in there and i'm without a home. Can I get the old renter out of the house before the 1st?

you have to serve him with a notice to quit the premises and if he fails to do so you must file a lawsuit against him to get him out. I'd sue the guy who sold you the house for any of your out of pocket expenses that he caused and give him a notice to get the guy out of the house. It's also your fault for buying the house while someone was still living there.
You should have checked the house and you would have found the guy living there. then you could have asked him if he knew he had to get out and you wouldn't have bought the house under those circumstances. Idaho is a buyer beware state.
