Legal Question in Personal Injury in Idaho

car wreck settlement

On dec. 9, 1997, my 18 year old daughter was hit head on on school property. The other driver was found 100% at fault. She has since had bad back pain and an MRI showed "protrusions between theT8-T9 and T10 discs". The Doctor said nothing should be done now but he doesn't know about her future (10-20-30 year). Now when we settle I need some advise. What do we go for and do we need a lawyer?

PS Even with her lap and shoulder belt on she hit the windshield and broke it!!!

If you were in my office and asked me if you should settle at this point, then I would tell you no. You (or your daughter) need to know from the medical treating doctors if she is at a medical end point. While an insurance company may be willing to settle with you at this point it will only be for a fraction of what they should pay. The Company may see some risk in the future and try to get you to settle know before you know the real impact of this injury. It is impossible to put a value on this claim because it only happened 2 months ago.

Get to an attorney and have him or her review all of the legal angles. You may have coverage under your own policy, the other driver's and is there an action against the school. I can't answer these questions. You need a Florida attorney.
